Baby Bundle is committed to protecting and respecting Your privacy. This Privacy Policy (the ‘Policy’) (together with the Terms of Use and other documents referred to in them) sets out the basis on which any data We collect from or about You, or that You provide to Us, will be processed by Us.

Baby Bundle is the trading name of NICAB Limited (hereinafter referred to as ‘Baby Bundle‘ or ‘We‘, ‘Us‘ or ‘Our‘). We are a company incorporated in Jersey (registered no. 117996) whose registered office is at PO Box 641, No 1 Seaton Place, St Helier, Jersey, JE4 8YJ, Channel Islands. For the purpose of the Data Protection Act 1998, We are the data controller.

Unless otherwise indicated, all definitions used in the Mumsnet Baby Bundle App Terms shall apply to this Policy. In this Policy, references to ‘You‘ and ‘Your‘ are references to a Baby Bundle Member.

You should read this Policy carefully and must accept its terms when prompted to do so before proceeding to use the App and/or the Interactive Services. Your continued use of the App and/or the Interactive Services shall indicate Your continued acceptance of the terms of this Policy. By accepting the terms of this Policy and continuing to use the App and/or the Interactive Services, You shall also be deemed to accept the same on behalf of Your baby in respect of any data processed by Us in relation to Your baby. If You no longer agree with the terms of this Policy, please refrain from using the App and/or the Interactive Services.

1. WHAT TYPES OF DATA DO WE COLLECT?

We may collect the following types of data about You:

· Personal Data

We collect the content and other data You provide when You use the App and the Interactive Services, including when You sign up for an account, publish content or communicate with others. This data includes information about You as a Baby Bundle Member (including Your name and email address) and information about Your baby (including, but not limited to, its name, sex, expected date of birth, date of birth, measurements, daily activities and photos).

· Your Activity

We collect data about how You use the App and the Interactive Services so that We can better understand the behaviour of Our Baby Bundle Members to enable Us to improve the App, the Interactive Services and any sponsored advertising. This data includes the types of content that You publish via the App and Interactive Services and the frequency/duration of Your activities in using the App (including the sections visited, the length of time spent visiting each section and the nature of the interaction). This data is always aggregated and cannot be used to identify You as an individual.

· Device Data

We collect data from or about the devices where You install or access the App and/or Interactive Services. This data can include information such as Your Device’s technical specification, its operating system, language, time zone and other data such as the location in which the App is being used. This data is also aggregated and cannot be used to identify You as an individual.

· Financial Data

We do not currently take payment details on the App. If You purchase a product after visiting any affiliated retailers that are mentioned on the App, the payment and other policies of the Third Party Retailer and those of their specific service providers will apply and We shall have no liability for any such purchases made by You.

2. HOW DO WE USE THIS DATA?

We use this data to do the following:

· Provide and Tailor the App and Interactive Services

We may use the data to help Us understand how You use and interact with the App to allow Us to tailor the content within the App and Interactive Services to meet Your requirements.

· Monitor and Improve the App and Interactive Services

We also want to create the best user experience for You as a Baby Bundle Member. We use and analyse the data We collect to aid the technical administration of the App and Interactive Services, to better understand the functioning of the App and Interactive Services, to create new software updates for the App and to provide more relevant sponsored advertising, each in order to improve the App and Interactive Services to enhance Your Baby Bundle experience.

· Communicate with You

We use Your data to communicate with You and let You know about changes to the App, the Interactive Services, Our Terms of Use and/or this Policy.

3. HOW MAY YOUR DATA BE DISCLOSED?

Your data may be disclosed to the following:

· People You communicate with

When You publish content and communicate using the App or Interactive Services with another Baby Bundle Member or third parties, You choose the data that You share and do so at Your own risk. People that You share Your data and communicate with may download or re-share this content with others on and off the App and out with the scope of the Interactive Services. You are responsible for this data and should be careful about the data You choose to share. If You have concerns about any data shared by another Baby Bundle Member, please contact Us using the contact details set out in Section 8 below.

· Service Providers

We may transfer Your data to third party service providers who provide, support and/or improve the App and/or Interactive Services. These third parties are required to adhere to strict confidentiality obligations that are consistent with the terms of this Policy. We will not transfer Your data to third parties for the purposes of making marketing communications unless You have expressly consented to this.

· Third Parties outside the European Economic Area (EEA)

From time to time, We may transfer Your data to a related company, agent or contractor in order to improve the App and/or Interactive Services or to assist Our security, credit risk or fraud protection activities. Such companies, agents and/or contractors may be located outside of the EEA and may store and/or process such data on Our behalf. By disclosing Your data to Us via the App and/or Interactive Services, You consent to any such transfer, storage and/or processing of Your data for these purposes. We will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Policy.

· Selected Research Partners

We may provide de-personalised statistical data collected from Baby Bundle Members to Our carefully selected partners for the purposes of statistical analysis, research and/or drawing conclusions from demographic information. This will allow us to better understand user behaviour and improve the App and Interactive Services. This data is always aggregated and cannot be used to identify You as an individual.

· Regulatory Bodies / Law Enforcement Agencies

We may disclose Your data if We believe that doing so is necessary to assist law enforcement and/or to comply with any law, regulation, regulatory or government agency, or pursuant to an order of a court, arbitrator or tribunal anywhere in the world. We will not disclose Your data unless We are permitted to do so by law.

· Other Applications and Websites

The App may contain links to other applications and websites, including social media sites, the “Mumsnet Talk” application and other applications and websites owned and/or operated by third parties. If You follow a link to any other application or website, please note that they will be subject to separate terms of use and privacy policies, and Baby Bundle is not responsible for the terms of use, privacy policies, practices or content of such applications and websites (including those of Third Party Retailers). You should be careful to read and understand those terms independently. We may also provide information about You as a Baby Bundle Member (including your name and email address) to our affiliate, Mumsnet, for the purposes of granting You Mumsnet membership.

· New owner of Baby Bundle

In the event that Baby Bundle is sold (in its entirety or in part) or transfers some of its assets to another party, Your data may be part of the assets transferred as part of the transaction. If Your data is transferred, its use will remain subject to the terms of this Policy. Your data may be passed on to a successor in the event of a liquidation or administration of Baby Bundle. To the extent required by law, We will seek Your consent prior to any such transfer of Your data.

4. HOW DO WE PROTECT YOUR DATA?

The privacy and protection of Your data is important to Us and We use all reasonable endeavours to comply with the provisions of the Data Protection Act 1998. Any Baby Bundle Member statistics that We may provide to prospective partners regarding Your usage of the App and/or Interactive Services are provided in the aggregate only and do not include any individually identifiable data.

We take reasonable security measures and precautions to protect Your data, including administrative, technical and physical measures to safeguard Your data against loss, theft and misuse, as well as against unauthorised access, disclosure, alteration and destruction.

Unfortunately, however, the transmission of information via the internet is not always encrypted or completely secure. Any information that You send to Us from Your Device via the internet therefore may not be encrypted or secure. Despite efforts to protect Your data, We cannot ensure or warrant the security or confidentiality of any data You transmit to Us, via, to, or from the App using Your Device, and You accept that Baby Bundle cannot be held liable for any breaches of security or confidentiality that may occur as a result of any such transmission. If there is any sensitive or confidential data which You do not wish to communicate using the internet, please contact Baby Bundle by telephone or post to arrange an alternative method of communication. You transmit all such data at Your own risk. Once We have received Your information, We will use the security procedures referred to above to try to prevent unauthorised access.

5. HOW CAN I MANAGE OR DELETE DATA ABOUT ME?

Baby Bundle makes it easy for You to keep the data We hold about You accurate, complete and up to date. You may ask Us in writing for a copy of the data We hold about You (for which We may charge a fee) and to correct any inaccuracies in Your data. We aim to respond to You within 21 days from the date of request. To make a request to Baby Bundle, You need to put the request in writing addressing it to the relevant address provided below.

You also have the right to ask Us not to process Your data for marketing purposes. We will usually inform You (before collecting Your data) if We intend to use Your data for such purposes or if We intend to disclose Your data to any third party for such purposes. You can exercise Your right to prevent such processing by checking certain boxes on the forms We use to collect Your data. You can also exercise the right at any time by sending an email to info@babybundleapp.com.

We will retain Your data for the period necessary to fulfil the purposes relevant to the App and the Interactive Services, or as otherwise required by law. Any information provided to us by You will be kept until Your Baby Bundle account is deleted, unless a longer retention period is required by law.

6. COOKIES AND OTHER SIMILAR TECHNOLOGIES

The App uses cookies and other similar technologies (including analytical, performance and functionality tools) to improve your browsing experience. The App uses these technologies to collect the data described in Section 1 above and to help Us to achieve the aims set out in Section 2 above. If You continue to use the App, We will be entitled to assume that You have consented to this. If You disagree with the App’s use of these technologies in the manner described, please refrain from using the App and uninstall it from Your Device.

7. CONTACTING YOU

You acknowledge that We may contact You using the contact details you have provided to Us by post, phone or by electronic mail in connection with Your Baby Bundle Account and the Interactive Services. From time to time, Baby Bundle may contact You by electronic mail with newsletters, information and/or offers regarding products, services, promotions, Interactive Services or surveys.

OPTING OUT: If You do not wish to be contacted by Baby Bundle and/or Mumsnet in respect of Our future marketing communications (excluding the welcome email and any Message Notifications which cannot be opted out of), You can either select an unsubscribe option from any email You have received or contact Baby Bundle by sending an email to info@babybundleapp.com with “URGENT – UNSUBSCRIBE REQUEST” in the subject line or send Your request by post to Baby Bundle at the contact address below.

8. CONTACTING US / COMPLAINTS / QUERIES

Baby Bundle is committed to protecting and respecting Your privacy, and the security of Your data is important to us. For this reason, We take any complaints We receive about this very seriously. We encourage people to bring it to Our attention if they think that Our collection or use of data is unfair, misleading or inappropriate. We would also welcome any suggestions for improving Our procedures.

9. CHANGES TO THIS POLICY

We keep Our Policy under regular review. We reserve the right to make changes to the terms of this Policy at any time. To the extent that We make any changes to the terms of this Policy relating to the processing of any sensitive personal data relating to You or Your baby, We will give You express notice of these changes and request Your consent to them (which will be a condition of Your continued use of the App and the Interactive Services). We may make any other changes to the terms of this Policy at any time without notice, which will be effective upon the posting of the revised Policy via the App, and if You continue to use the App and/or the Interactive Services, We will be entitled to assume that You have accepted the changes. If You no longer agree with the terms of this Policy, please refrain from using the App and the Interactive Services.
